Discrimination – for Managers and HR

When personal characteristics lead to disadvantages

Discrimination in the workplace is the unfair or discriminatory treatment of employees based on personal characteristics such as gender, age, origin, religion, sexual orientation and disability.

Discrimination can manifest itself in different ways. Overt discrimination includes, for example, unequal pay or lack of promotion opportunities for certain groups.

Indirect discrimination can be seen, for example, in company policies that inadvertently exclude certain employees.

On an interpersonal level, discrimination manifests itself through derogatory remarks and a failure to respect and value others.

Discrimination in the workplace: what you should know!

Does all unequal treatment constitute discrimination?

No. Unequal treatment is discriminatory only if it is based on characteristics such as gender, origin or sexual orientation and is not objectively justified. In other words, objectively justified unequal treatment of employees – for example, based on qualifications or professional experience – does not constitute discrimination.

What is covert discrimination?

Covert discrimination occurs through seemingly neutral measures that disadvantage certain groups, for example through recruitment criteria that indirectly exclude women or older applicants. Covert discrimination is often the result of unconscious prejudice.

How do I prevent discrimination? ?

Respond immediately to any discrimination – even if it is expressed in a humorous way. You should also look out for complaints, inequalities in terms of promotion and/or noticeable termination rates among certain groups. Regular employee surveys can also help to identify discrimination.
